Bill passes to uphold 4th Amendment protections in Colorado


This month, the Colorado legislature reaffirmed it's commitment to the 4th Amendment.  Prior to this legislation, if an individual was wrongfully stopped by law enforcement and arrested for DUI, their lawyer could argue to the DMV that such a stop was unconstitutional and that the driver's license action should be dismissed.  However, the DMV hearing officer was not bound to follow the constitutional concept of being free from unreasonable searches and seizures.  This is a significant step forward in the protection of personal liberties.
