Anything you say can AND WILL be held against you
While waiting for my client's DUI case to be called this week in a Denver court, I was closely listening to the judge sentence another DUI defendant. This defendant had told the arresting officer, by way of explaining why he had consumed too much alcohol and then driven, "it's cheaper to have an officer drive him home than to call a cab."
First, he couldn't be more wrong. Between fines, court costs, alcohol monitoring and classes, probation supervision fees, and a myriad of other costs, most DUI defendants in Colorado are out well over $1000 without ever having spoken with a DUI defense lawyer. Second, even a first offense DUI can result in up to one year of incarceration in the county jail. This doesn't happen often but if you give a sentencing judge a reason to throw the book at your, they might just do it! You have a right to remain silent. Please use it.
